Terms & Conditions

1. THE CONTRACT

This booking is negotiated by Josh Nesbitt (‘the Artist) with the Client, and each party agrees to abide by these terms and conditions.

 

2. BOOKING FORM/PROPOSAL CONFIRMATION

Bookings are confirmed upon electronic acceptance of the proposal and Deposit by both the Client and the Artist. Once the booking is confirmed, the Client and the Artist shall be bound by these Terms and Conditions.

 

3. AUTHORITY TO SIGN

The person signing this contract on behalf of the Client must have authority to bind the Client in such a contract, and if they do not have such authority they will be personally liable for any fees payable under these Terms and Conditions.

 

4. BOOKING FEE

The Booking Fee is a non-refundable pre-payment fee which is payable by the Client to the Artist on at least 7 days before the event of. The Booking Fee is payable to the Artist at the point of booking by bank transfer (an invoice can be provided). If the Client fails to pay the Booking Fee the Artist shall have the option of treating the failure as a cancellation by the Client and free the Artist from all contractual obligations. However, the Client will still be bound by Clause 6 of these Terms & Conditions and any payments due under Clause 6 will still be payable to the Artist.

 

5. CONTRACTS

Upon digitally signing the Booking/Proposal Form this forms the live contract between the Artist and the Client. Any cancellations from there on will evoke Clause 6.

 

6. CANCELLATIONS

a) Cancellation by the Client:
All cancellations must be made in writing to the Artist and will be subject to the following terms:
In the event of cancellation of the contract by the Client the Booking Fee will not be refunded and in addition to this
i) if the Contract is cancelled by the Client within 90 days of the Event Date then 50% of the Balance will be payable;
ii) if the Contract is cancelled by the Client within 30 days of the Event Date then 100% of the Balance will be payable.
Any applicable cancellation fees shall be payable by the Client to the Artist within 7 days of cancellation notice. 

b) Cancellation by the Artist
Cancellation by the Artist is not permitted for any reason except circumstances covered by Force Majeure (see clause 10) or subsequent mutual agreement with the Client.
In the unlikely event of cancellation by the Artist, the Artist will refund the total fee paid by the Client.

 

7. BALANCE PAYMENT

Unless otherwise agreed, the balance payment is payable by the Client to the Artist 7 days prior to the Event Date. Any other arrangements for the payment of the Balance must be agreed between the Artist and the Client and must be stated on this contract. If a balance payment has not been received 7 days prior to the event (or within the time stated on the contract) the Artist may terminate the Contract without penalty. Additionally, the Client remains liable for cancellation fees as outlined in clause 6 of these Terms & Conditions.

 

8. LATE PAYMENTS

Any overdue invoices relating to this Contract (remaining unpaid beyond the stated payment period) may be subject to a £25 late payment charge. Any unpaid fees due to the Artist, whether due under clause 4 or clause 6 of these Terms and Conditions, will be referred to a recovery company and will be subject to a surcharge to cover any collection costs incurred. This surcharge together with all other charges and legal fees will be the responsibility of the defaulting party. 

 

 

9. CHANGES TO CONTRACT

Any changes to the contract details must be authorised by the Artist prior to the Event Date. If changes are made to the contract the Booking Fee amount may be subject to change. Any changes made to the contract without the consent or knowledge of the Artist are undertaken entirely at the risk of the Client and the Artist and will not form part of this Contract.

Overtime will be charged at per half hour, unless Client has another engagement to attend so is not always guaranteed. Artist’s decision to depart at agreed time is final )     

 

10. FORCE MAJEURE

In cases of Force Majeure (which shall be known as war, fire, death, serious illness, epidemic, strike, labour dispute, accident, civil commotion, national calamity, act of God) which are not attributable to any act or failure to take preventative action by the Client or the Artist, then the Client or Artist may cancel this booking without penalty other than loss of the Booking Fee.

 

11. TRAVEL AND ACCOMMODATION (WHEN APPLICABLE)

Unless there is prior agreement with the Artist, should the event be further than 100 miles from where he resides (North London), accommodation will be required under this contract. Travel outside of X will incur either a train ticket if client is providing a piano or keyboard. are to the event location or 25p per mile (shortest route) too and from the venue. For events abroad, airline tickets and accommodation will be required for the Artist. If the event is a Sunday (abroad only), the Artist will require accommodation one day prior to the event and the night of the event (unless agreed otherwise). For abroad events only – the client is responsible for the Artists travel to and from the airport upon arrival and departure. The client is also responsible for the Artists travel too and from the venue on the day of the event or before if required and agreed prior.

 

12. RECORDINGS

The Artist reserves the right to make audio and video recordings of performances at the event and can post online for professional marketing purpose.

 

13. TECHNICAL RIDER

Please provide a power source for Artist to plug in his equipment. For events in England, or other where Artist will not be flying, Artist can provide his own equipment. As standard, Artist will provide Nord Piano 5 Stage Piano and Bose L1 Compact PA system (suitable for up to 150 people). Artist can provide White Baby Grand Piano Shell (will incur cost to be agreed with Artist). Client is welcome to provide a stage piano for Artist however it must be a Nord instrument and have 88 notes. Client is also welcome to provide a baby or Grand Piano (onsite or hired) however it must be in suitable conditiion and in tune.

 

For events abroad, Client is responsible for hire of equipment and the costs incurred. The Artist requires Nord Stage Piano of any type, but must have 88 keys. Client is welcome to provide a Grand Piano (baby or standard size) but must be in suitable condition and in tune. Artist requires both hot meal and soft drinks if Artist’s attendance is required longer than 2 hours.
